Freckl – Terms & Conditions of Sale

These Terms & Conditions apply to all orders placed with Freckl (“we”, “us”, “our”) for custom printed packaging and related services. By placing an order, you agree to be bound by these Terms. Please read them carefully before purchasing.

2. Who We Sell To

We sell to both consumers and businesses. If you are a consumer, you have certain additional rights under UK consumer law, which are outlined in Section 7. If you are buying on behalf of a business, your purchase is considered a business-to-business (B2B) transaction and different terms may apply.

3. Products and Services

Freckl supplies made-to-order, custom printed packaging products. Due to the bespoke nature of our work, minor variations in colour, size, or finish may occur and are considered acceptable within standard manufacturing tolerances.

4. Orders and Approvals

Orders are only confirmed once accepted by Freckl. You must review and approve all artwork and specifications before production begins. Delays in approval may affect delivery timelines.

5. Pricing and Payment

All prices are stated in GBP ex VAT. Full payment is typically required before production begins unless credit terms have been agreed. We reserve the right to charge interest on overdue payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 for B2B clients.

6. Delivery

Delivery dates are estimates and not guaranteed. We are not responsible for delays due to third-party couriers, supplier issues, or force majeure events. Risk in the goods passes to you upon delivery. Title remains with us until full payment is received.

7. Returns, Cancellations & Consumer Rights

Custom printed and made-to-order products are non-refundable and cannot be returned, unless faulty or not as described. This applies to both consumers and businesses. Under the Consumer Contracts Regulations 2013, consumers normally have a right to cancel online purchases within 14 days. However, this right does not apply to custom or personalised goods. If your order is faulty or incorrect, please notify us within 5 working days of delivery with clear details and photographs of the issue.

Cancellations requested after artwork has been approved may be charged in full or in part depending on how far production has progressed.

8. Tolerances

Due to the manufacturing process, minor tolerances in board thickness, dimensions, colour matching and print alignment may occur. These are not considered defects and are industry standard.

9. Intellectual Property

All designs, drawings, templates, and visualisations created by Freckl remain our property unless otherwise agreed in writing. You confirm that any content you supply (including artwork or logos) does not infringe any third-party rights.

10. Confidentiality

Both parties agree to treat any sensitive or proprietary information shared in the course of doing business as confidential and not to share it without written consent.

11. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the value of the goods supplied. We are not liable for any indirect or consequential losses. Nothing in these terms excludes or limits your statutory rights as a consumer, or our liability for death or personal injury caused by our negligence.

12. Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, such as supplier delays, shipping disruption, strikes, or natural disasters.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
